Welcome to Self Made Athletes. These Terms of Service ("Terms") govern your use of the selfmadeathletes.com website and any related services, including the sale of athletic apparel and online fitness coaching services ("Services"). By accessing or using the Services, you agree to be bound by these Terms.

  1. Use of the Services

You may use the Services only for lawful purposes and in accordance with these Terms. You may not use the Services:

  • In any way that violates any applicable federal, state, local, or international law or regulation

  • To transmit any unsolicited or unauthorized advertising or promotional materials

  • To transmit any viruses or other malware that may harm the Services or any users of the Services

  • To interfere with or disrupt the Services or servers or networks connected to the Services

  1. Account Creation and Security

In order to use certain features of the Services, you may be required to create an account. You agree to provide accurate and complete information when creating your account and to keep your account information up-to-date. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer or mobile device. You agree to accept responsibility for all activities that occur under your account or password.

  1. Intellectual Property

The content and materials available through the Services, including text, graphics, logos, images, and other materials (collectively, "Content"), are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works based on the Content without our express written permission.

  1. Payment and Fees

You agree to pay all fees associated with your use of the Services, including the purchase of athletic apparel and online fitness coaching services. Prices are subject to change without notice. Payment may be made using a credit card or other payment method accepted by us.

  1. Refunds and Returns

We want you to be satisfied with your purchase. If you are not satisfied with your purchase, please contact us within 30 days of receiving your order to request a refund or return. Refunds and returns are subject to our Refund and Return Policy, which can be found on our website.

  1. Disclaimer of Warranties

The Services are provided on an "as is" and "as available" basis without any warranties, express or implied. We do not warrant that the Services will be error-free or uninterrupted, or that any defects will be corrected. We are not responsible for the accuracy, completeness, timeliness, or reliability of any content provided through the Services.

  1. Limitation of Liability

To the fullest extent permitted by law, we will not be liable for any damages of any kind arising from the use of the Services, including but not limited to direct, indirect, incidental, punitive, and consequential damages.

  1. Indemnification

You agree to indemnify, defend, and hold us and our affiliates, officers, directors, employees, and agents harmless from any and all claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from your use of the Services or any violation of these Terms.

We may terminate your access to the Services at any time, without notice, for any reason, including if we believe that you have violated these Terms. You may also terminate these Terms by ceasing to use the Services.

  1. Governing Law

These Terms and any disputes arising out of or related to these Terms or the Services will be governed by the laws of the State of California, without regard to its conflict of laws provisions.

  1. Miscellaneous

These Terms constitute the entire agreement between you and Self Made Athletes regarding the Services. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

  • Our failure to enforce any provision of these Terms does not waive our right to enforce that or any other provision in the future.

  • These Terms are binding upon and will inure to the benefit of you and us and our respective successors and assigns.

  • We may assign or transfer these Terms, in whole or in part, without your consent or notice.

  • You may not assign or transfer these Terms or any of your rights or obligations under these Terms without our prior written consent.

  • These Terms do not create any agency, partnership, joint venture, or employment relationship between you and us.

  • These Terms and any rights and licenses granted hereunder may not be transferred or assigned by you, but may be assigned by Self Made Athletes without restriction.

  • Any headings or titles in these Terms are for convenience only and have no legal or contractual effect.

  • We may provide notices to you by email, regular mail, or posting on the Services. You may provide notices to us by email or regular mail at the address provided on our website.

  • These Terms are the entire agreement between you and Self Made Athletes and supersede all prior agreements and understandings, whether written or oral, relating to the subject matter of these Terms.

Mobile Terms and Service

The Self Made Athletes mobile message service (the "Service") is operated by Self Made Athletes (“Self Made Athletes”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Self Made Athletes’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Self Made Athletes through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Self Made Athletes. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to +18444202046 or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Self Made Athletes mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
